More information has come out about Bravo’s The Real Housewives of New Jersey cast member Teresa Giudice’s malpractice lawsuit against her former bankruptcy lawyer and it has been made even clearer as to why she believes it’s not her fault she’s behind bars.

The lawyer James Kridel, is defending himself and saying that it is Giudice herself is to blame for being sentenced to federal prison for serious fraud allegations including bankruptcy fraud. He revealed that Giudice was extremely close to not getting any jail time at all.

 But one decision she made changed her fate and future.

“She went to jail because she committed crimes, which were not participated by me,” he told People Thursday. “I have read the transcript and the judge made it very clear that she had originally decided not to send her to jail, but because she had falsified her assets before the sentencing she decided to send her to jail.”

He added that Giudice did not file income taxes long before he even met her. He also said that she lied on her W2 when it came to cases surrounding her mortgage.

“That has nothing to do with her bankruptcy.”

Still, the new lawyer who is representing Giudice in the malpractice lawsuit against Kridel, has maintained that Giudice is in jail as a result of “Kridel’s negligence.”

He said in the lawsuit, “Defendant Kridel continuously filed documents that were materially inaccurate, but he permitted Plaintiff Giudice tos gin decorations under penalty of perjury that the documents were accurate.”
