After months of dragging his feet when it comes to granting Kim Kardashian a divorce, Kris Humphries will finally face the judge in a divorce court trial date set for May 6. Humphries has been slow in granting Kardashian’s wish to be divorced because he wants to prove the marriage was a fraud so that he can have an annulment.

Kim responded to Humphries claim asking the court to grant her a divorce because the battle was a danger to “the health and well-being to her unborn child.”

This is good news for Kardashian who is due to deliver her baby in July and wants to move on with her new life with her rapper-boyfriend, Kanye West. Neither parties were in court on Friday when the judge set the date.

LA Supreme Court Judge Stephen Moloney who is presiding over the case believe Humphries has had ample to time to get his ducks in a row.

"Humphries has had more than adequate time to prepare," he said at the hearing on Friday.

Even Humphries' attorney has shown signs that he is ready to move on from the lagging case, as he filed papers to be removed as the NBA player’s attorney on Friday. Humphries lawyer, Marshall Waller cited “irreconcilable differences” and “irremediable breakdown” in his attorney-client relationship.

Kardashian’s lawyer, Laura Wasser told PEOPLE magazine that divorce is the only evident outcome to end the relationship.

“We want a trial because that's the only way this will end," Wasser said. "There was no fraud. They have no case."

Divorce or no divorce, Kardashian has made it clear that she is ready to close off that chapter of her life. Earlier this month, she purchased an $11 Million mansion in Bel Air with her boyfriend, West. The huge LA pad boasts 10,000 square feet and is set in an ultra-private gated community. The couple intends to expand the place to 14,000 square feet to include all the luxurious necessities – a gym, movie theater, full-sized makeup and hair salon, bowling alley, basketball court and an indoor and outdoor pool.
