We now know the real reason why Teresa Giudice of Bravo’s The Real Housewives of New Jersey bankruptcy troubles has resurfaced.

As Giudice gears up to sue her bankruptcy attorney for malpractice, the trustee who handled her case, John W. Sywilok is coming for her on behalf of the creditors that she still owes.

“My function is to be a representative of all the unsecured creditors of the estate,” Sywilok dished to Radar Online Wednesday. “As far as I know, none of them have been paid. That’s my understanding.”

Giudice’s bankruptcy case was closed on September of 2014 amid her and her husband, Joe Giudice’s legal troubles. They pleaded guilty to serious fraud charges such as bankruptcy, mortgage and tax evasion. Even though Teresa served her time, and Joe is currently in prison, it seems the creditors are still looking for the money. And it looks like they are hoping to get it if Giudice wins her case against her bankruptcy lawyer.

Sywilok added, “Any funds released from this action would benefit the unsecured creditors. They are the general creditors. They’re not like banks that have collateral.”

Sywilok said that any funds Teresa gets from the case could be considered assets.

“Anything that occurs before bankruptcy whether it’s the nature of malpractice or not, is the property of the bankruptcy estate…Once I get reappointed, it’s my function to liquidate any assets for the benefit of the creditors.”

As for Teresa’s attorney in her case, Carlos Cuevas, he said he has no knowledge of whether the creditors should get their money if Tersea wins.
“I didn’t represent her in the bankruptcy case, so I wouldn’t know. It was Mr. Kridel who represented her in the bankruptcy case.”
