Jodi Arias returned to court in Arizona on Tuesday and her defense attorneys will ask a judge to make her ineligible for the death penalty.

Tuesday's hearing will focus on her death penalty eligibility. The request, if approved, will help reduce the chances of the convicted killer going through a second sentencing trial, according to The Associated Press.

Taking the death penalty off the table would have Arias either spend the rest of her life in prison or be eligible for release after 25 years, according to Fox News. The decision would be up to the judge. Maricopa County Attorney Bill Montgomery previously said the state is ready to seek the death penalty again for Arias but would consider resolving the case without another trial only after speaking with the victim's family and defense lawyers.

After Arias was convicted of murder on May 8, the same jury agreed on May 15 that she killed Travis Alexander in an "especially cruel manner." According to Arizona law, "cruel manner" is when a victim suffered physical and or mental pain. According to Alexander's autopsy report, Arias stabbed himat least 27 times, slit his throat from ear to ear and shot him in the forehead. 

Arias's attorneys on Tuesday asked Judge Sherry Stephens to throw out the the decision by the last jury that the murder was "especially cruel." Attorneys Kirk Nurmi and Jennifer Wilmot argued that a jury is not qualified to make that ruling because it lacks sufficient legal knowledge on the matter.

In the third sentencing phase of Arias' trial, the same jury failed to reach a unanimous decision as to whether she should be sentenced to life or death on May 23. The judge was forced to then forced declare a mistrial because of the deadlocked jury. 

If the judge rules that Arias is eligible for the death penalty, there will be a retrial of the sentence phase with a new jury. The new jury selection process will move forward on July 18.  If the new jury votes that she receives the death sentence in the third sentence phase, she will be the fourth woman in Arizona to do so.

Arias' sensational trial began in January. She took the stand for a marathon 18 days and maintained throughout that the killing was in self-defense despite fierce cross-examination by prosecutors. The Lifetime network premiered the original movie about Arias' relationship with Alexander, titled Jodi Arias: Dirty Little Secret, on Saturday, June 22.
