Rihanna won a $5 million lawsuit against Topshop after the company sold T-shirts with her likeness without her permission.

High Court Judge Justice Birss ruled in two minutes that a "substantial number" if the pop singer's fans purchased the tops out of "false belief," BBC reported on Wednesday.

The Diamonds singer's attorneys argued that the image used on the top closely resembled photos taken during filming of a Rihanna music video shot in northern Ireland, That same image was later used to on the CD sleeve of her Talk That Talk, according to the report.

Judge Birss agreed, stating that "Topshop's sale of the T-shirt was an act of passing off." The judge, however, carefully noted that Topshop using the photograph did not "breach Rihanna's privacy" and "the mere sale by a trader of a T-shirt bearing an image of a famous person is not an act of passing off."

"The taking of the photograph is not suggested to have breached Rihanna's privacy," Birss said. "The mere sale by a trader of a T-shirt bearing an image of a famous person is not an act of passing off."

A rep for Topshop told BBC that the company was "surprised, disappointed and perplexed" by the judge's ruling.

New York Post reported on May 17 that the Bajan beauty filed a lawsuit after her team of handlers failed to negotiate with Topshop owners Arcadia Group for eight months. A source told the newspaper that Rihanna personally took offense when they "offered $5,000 and said they don't care."

"What is most offensive for Rihanna is that they basically told her, 'Go to hell. We don't care; we are going to continue selling you'" the source the publication.

The insider said the singer spent $1 million in legal fees because the UK laws does not protect artists and she wanted to "make a statement about it."

"She says it's the principle,," said the insider, adding, "they are taking advantage of artists. It is just exploitation. What they are doing is wrong."
