Tracy Morgan is slowly recovering after being injured in car crash on the New Jersey Turnpike earlier in June.

"Happy to pass along that Tracy has been upgraded to fair condition, which is a great improvement," his publicist Lewis Kay said in a statement. "His personality is certainly starting to come back as well."

The 45-year-old actor and comedian was left in critical condition after a Walmart truck hit into the limo bus that he and four others were traveling in on the northbound New Jersey Turnpike in Cranbury Township. Morgan was returning from his standup show the night prior at the Dover Downs Hotel & Casino in Delaware.

The father of four had undergone surgery for a broken leg after the June 7 accident and also had broken ribs, a broken nose and femur. The accident killed fellow comedian James McNair, known as Jimmy Mack, and injured two others.

The truck driver, Kevin Roper of Jonesboro, Ga., pleaded not guilty after he turned himself into police the night the accident occurred and was given a bail of $50,000. Prosecutors said that Roper hadn't slept for over 24 hours before the collision. Roper, 35, is charged with one count of vehicular homicide and several counts of assault by auto. He could face up to 10 years in prison, according to reports.

Following the fatal incident, TMZ released a video which displays the car crash. Many tweeted the website to remove the clip, including film producer Judd Apatow. "@HarveyLevinTMZ please take down the accident video," he wrote on June 12 to the owner of TMZ.
