It looks as though Abby Lee Miller might be lucky enough to avoid a huge misstep she took with former Dance Moms star Kelly Hyland. According to a new report, a judge in Hyland's defamation and emotional distress case against Miller might be tossed out the window.

Abby Lee Miller Not Returning To The Show Because Of Her Lawsuit?   

Hyland is suing Miller for $5 million after a clash between the two ladies back in November 2013. Hyland claims Miller was "bullying and insulting" her along with her daughters on the show before she slapped her in front of the camera.

According to Deadline.com posted on Thursday, Judge Ruth Kwan indicated that she will likely throw out the defamation and emotional distress claims that cast member Hyland and her daughters slapped Miller and producers Collins Avenue Entertainment with in their multi-claim February 19 complaint.

The site also adds that the judge cautioned lawyers that she hasn't made a final decision yet. Judge Kwan also says she may allow Hyland's breach of contract claims against Collins to continue based on a further hearing next week. The assault claim by Hyland in this case still looks to stand. Miller has gone after Hyland also saying she assaulted her.

Meanwhile, it looks as though Hyland is using Twitter to allegedly expose Miller's "bullying" towards her students.

Just last Monday, Hyland retweeted an article that asks, "Why is Abby Lee Miller allowed to be a bully?" while questioning her teaching methods.

Michelle Carlbert of Buddy TV wrote in the post, "So why is it that Abby Lee Miller is allowed to use manipulation, intimidation, insults and name calling to teach her students? Well one reason could be that people think it's a necessary part of her teaching method, but I think that it's probably a lot simpler than that: she's never been forced to stop."
