A day after Walmart blamed Tracy Morgan for his own injuries in the car crash from earlier this year, the 30 Rock star's lawyer is firing back at the superstore giant.

Walmart Says Tracy Morgan is To Blame Over Injuries in New Jersey Turnpike Accident For Acting 'Unreasonably'

On Tuesday, Walmart blamed Morgan for not wearing his seatbelt in his limo that was hit by a Walmart truck in June. "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests," Walmart's 28-page response read. "Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise of reasonable conduct using the available seatbelts."

On Wednesday, Morgan's lawyer Benedict Morelli fired back and said he was "shocked" and "upset" at their claims.

"All of my clients have had traumatic brain injuries and they are all extremely injured," Morelli told ABC News. "It is actually an embarrassment that they are putting in an answer like this, blaming the victims. It is not appropriate." Morgan is still "trying to recover" after the tragic accident.

Morelli revealed that Morgan is still in a wheelchair and is still struggling along. "Also Tracy is fighting so hard to recover and when Walmart puts out a statement like this... it makes all of the families of my clients very upset."

Morgan also issued a statement on Tuesday after Walmart's statements. "After I heard what Walmart said in court I felt I had to speak out," Morgan said in a statement. "I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."
