Tracy Morgan Is 'A Fighter' But Still Struggling After Walmart Car Accident

Morgan's limo was hit in New Jersey this summer by a Walmart truck and trucker fatigue could be one of the reasons for the accident.

Police had said the driver went over 24 hours without sleep. Although he wouldn't comment on the open investigation, Rob Molloy, deputy director of National Transportation Safety Board's office of highway safety, said "Over and over, we're seeing drivers who aren't fit to drive because they're fatigued involved in accidents."

In a new response recently, Walmart tried to blame Morgan for not wearing his seatbelt in the limo and being partly responsible for his accident.. "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests," Walmart's 28-page response read. "Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise of reasonable conduct using the available seatbelts."

Morgan's lawyer than issued a statement on behalf of the comedian where he said Morgan was "shocked" by Walmart's comments.
