Jodi Arias could possibly not have to worry about the death penalty after all.

On Thursday an evidentiary hearing was held in regard to the porn allegations involving Travis Alexander's computer as reported by FOX 10 Phoenix.

The Arizona Republic further reported on Friday it was now up to Judge Sherry Stephens to decide if the death penalty will be off the table.

Arias' defense team went to war against the prosecution in court on Thursday.

Arias' lawyers, Jennifer Willmott and Kirk Nurmi, and their forensic expert, Bryan Neumeister, guided the court through a description of the porn sites that had been visited and the computer viruses that had infected Alexander's computer because of porn viewing.

Prosecutor Juan Martinez insisted Arias' previous defense team was responsible for any deletion of evidence on the computer though and then he also accused Neumeister.

Perry Smith, the Mesa police expert, went against Martinez's claims and admitted that there was porn.

In the closing arguments Thursday, The Arizona Republic reported that Nurmi said the state should not be allowed to continue going forward with the death penalty because the case is based on testimony that's not true.

"Let's put an end to this circus. Any further proceedings will be based on false evidence. This case is more about prosecutorial misconduct than it is about evidence," he said.

Martinez countered, "This is a fact-driven inquiry."
