Gabriel Aubry and Halle Berry are currently in the midst of a bitter court battle over whether or not she should be granted permission to move to France with their daughter Nahla. Citing that the United States has a stringent paparazzi, the 46-year-old actress is making the argument that it would be safer for the 4-year-old to move out of the country with her, according to TMZ.

However, Aubry's lawyer had countered with the complete opposite theory; stating that both Berry and her child would be walking into danger by leaving America. The attorney made claims that residing in France could put them in danger, as it is the country that the late Princess Diana was killed in on a paparazzi car chase in 1997.

Berry's team is said to have contacted several French lawyers, who attested that their respective court system would fully prosecute any photographer who gives the mother and daughter a problem.

In France, the law states that the media is not allowed to take any pictures of celebrities who don't wish to be photographed. Anybody who fails to obey the law can be sued for a maximum amount of dollars and can also be criminally prosecuted.

The celebrity trial will last for several weeks, claims the site.
