Lindsay Lohan can't seem to stay out of the spotlight - off-screen, that is.

On Sept. 19, she did a brief stint in jail for reportedly hitting chef Jose Rodriguez while attempting to park her Porsche Cayenne in New York City. The 26-year-old actress and her entourage left and went into the Dream Hotel after the incident. Because of this, Lindsay added a misdemeanor hit-and-run charge to her resume. 

Rodriguez told reporters Lohan "smelled like alcohol real bad" and was slurring her words, according to OK! magazine. The actress plans to sue Rodriguez for defamation.  

However, reports state alcohol was not involved in the incident and Lohan was not requested to take a field sobriety test.

"From what we know now, she will be completely exonerated," Michael Lohan, her father, told Celebuzz. "They tested her and she wasn't drinking. Lindsay is okay. She's sleeping, and I'm letting her rest."

Lohan is finally getting back on track -- she has roles in "Scream 5," "The Canyons" and "Liz and Dick" -- and she is afraid such rumors will prevent her from getting work. 

She has reportedly said she is "tired of people lying in order to score a quick paycheck." 

"We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue," Steve Honig, her representative, told the NY Daily News.

Allegedly, Lohan called her father while she was handcuffed to a bench during her short time in jail.

"I'm really proud Lindsay had the confidence to reach out to me," Michael said. "I'm also very proud that she wasn't drinking."
