Lindsay Lohan will not be charged for the alleged hit-and-run that took place in New York City on Sept. 19.

Lohan was scheduled to appear in court on Tuesday, Oct. 23, to follow up on her arrest for leaving the scene of a crime. However, surveillance footage that later emerged provided enough evidence for prosecutors to drop the case, according to TMZ.

The "Liz & Dick" star was arrested and briefly held in jail for reportedly hitting chef Jose Rodriguez with her car while attempting to park her Porsche Cayenne outside of a nightclub.

According to reports, the 26-year-old actress and her entourage went into the Dream Hotel following the incident shortly after midnight. When Lohan exited around 2:30 a.m., police were waiting for her outside. Officers took her into custody on suspicion of leaving the scene of an accident.

Lohan was booked on a misdemeanor charge and released around 4:30 a.m. with a desk appearance ticket. She did not have to pay bail before her release.

Rodriguez later told reporters Lohan "smelled like alcohol real bad" and was slurring her words, according to OK! magazine.

However, reports stated alcohol was not involved. Lohan called her father Michael while she was handcuffed to a bench during her short time in jail.

"I'm really proud Lindsay had the confidence to reach out to me," Michael said. "I'm also very proud that she wasn't drinking."

"We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue," Steve Honig, her representative, told the NY Daily News.

"From what we know now, she will be completely exonerated," her father Michael told Celebuzz. "They tested her and she wasn't drinking."

The actress said at the time that she intended to sue Rodriguez for defamation. She reportedly said she is "tired of people lying in order to score a quick paycheck." According to TMZ, Lohan stil intends to sue Rodriguez.
