Halle Berry's ex, Gabriel Aubry, alleged that the actress' current fiance, Olivier Martinez, threatened his life during their Thanksgiving Day fight, which reportedly Martinez started, People reported on Monday.

Aubry claimed that Martinez shouted at him during their brawl, "You cost us $3 million. When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you." He added that Martinez punched him, kicked him and knocked his head into the concete driveway of Berry's home. Aubry said security cameras from Berry's house would support his claims. 

The model noted that it all began on Thanksgiving eve when he drove up to Berry's house to drop off 4-year-old Nahla, the daughter he shares with the actress. 

"It all happened so fast and so suddenly; I did not see Mr. Martinez's actions coming, and thus, I was not ready for it and was not able to defend myself," Aubry's court papers stated.

During his alleged death threat, Martinez referenced the recent court ruling that restrains Berry from moving with Nahlia, whom she had with Aubry, to France, where Martinez is a citizen. Aubry's allegations are highlighted in the restraining order against Martinez that he filed, which the court granted. Aubry currently faces a restraining order that forces him to stay 100 yards away from Martinez, Berry and Nahla. 

A source close to Berry said the evening turned out a different way than Aubry lead on in his court papers. 

"This incident arose as a result of a fight initiated by Mr. Aubry when Nahla was delivered for Thanksgiving and Mr. Martinez attempted to have a discussion with him," the source told People. 

TMZ added that Aubry also stated in his court declaration an incident that occurred the day before his fight with Martinez. When both men attended Nahla's school play, Martinez allegedly whispered in Aubry's ear "I wish I could beat the s--t out of you right now. You're lucky we're in a school right now."
