It is being reported that Colorado shooting suspect James Holmes had been seeing a psychologist who dealt with schizophrenia prior to the "Dark Knight Rises" massacre that resulted in 12 deaths and 58 injuries. Apparently, the deranged killer had sent a notebook to University of Colorado specialist Lynne Fenton, in which details and drawings of his mass shooting plans were outlined.

There have been conflicting reports as to whether the package was sent in sufficient enough time to have possibly prevented the killings. However, due to a gag order handed out by the judge, officials have remained tight lipped about that respective information. 

Files found had stated that Holmes was Fenton's "psychiatric patient." The psychiatrist is a teacher in University of Colorado's medical program and leads the mental health services there as well. Unfortunately, the document did not indicate just how long the killer had been seeing Fenton or if she was indeed treating him for a mental illness.

Interesting enough, someone within the system had apparently leaked important information regarding the notebook, which defense attorneys say has compromised Holmes' right for a fair trial, according to The Nation.

"The government's disclosure of this confidential and privileged information has placed Mr. Holmes' constitutional rights to due process and a fair trial by an impartial jury at serious jeopardy," the attorney stated.

The defense team also said that the items in the package should not be used as circumstantial evidence because communication between Fenton and Holmes was "protected."

Prosecutor's shunned the motion of defense claiming that information regarding the package held "factual errors" and there was insufficient evidence that the government was to blame for the leaks.

Holmes, 24, is currently in solitary confinement at the Arapahoe County Detention Center and could receive the death penalty if convicted.  However, the state of Colorado has only executed one person since capital punishment's reinstatement in 1976.
