It's been more than a year since Kim Kardashian filed for divorce from Kris Humphires, and a trial is now set for February 2013.

A report from Hollywood Life confirms that the divorce case for their 72 day marriage will reach a courtroom in just a few months, after which Kardashian is hoping she will finally be legally single again.

A recent report claims Kardashian is threatening to sue Humphries if he and his legal team don't get a move on.

"She has instructed her lawyer, Laura Wasser, to give Kris and his lawyers an ultimatum: Settle now or she will sue," a source said, adding that a lawsuit could create a pile of attorney's fees for Humphries. "[They] could cost Kris millions."

Humphries is seeking an annulment rather than a divorce on the grounds that the marriage was a fraud to boost ratings for Kim's E! reality show, "Keeping Up With The Kardashians." The NBA player also wants Kardashian to return the diamond engagement ring he gave her.

But Kardashian is prepared to cite the ways Humphries has damaged her career and include that in her suit.

"Kim will launch a counterattack for defamation of character," the insider added. "You can't put a price tag on what Kris has cost her."

Kardashian's divorce attorney said in court that her client wants to move on from the 72-day marriage with Humphries, but that has become impossible as the basketball player and his legal team are still not ready to move forward with a trial, according to a report from USA Today.

"Ms. Kardashian is now handcuffed to Mr. Humphries," Wasser told Superior Court Judge Stephen Moloney.

Some reports have claimed Kardashian is ready to get engaged to current boyfriend Kanye West, but she is unable to move forward because she is still legally married to Humphries.
