The Real Housewives of Atlanta star Kim Zolciak recently claimed there is not merit to the lawsuit her former co-star Kandi Burruss filed against her regarding her hit song Don't Be Tardy For The Party. 

Burruss filed a lawsuit on March 12 against Zolciak for the single she released, Don't Be Tardy For The Party, because Zolciak commercially released the singe record without Burruss' "authorization, license or consent," according to a report. A week later, a rep for Zolciak, Mike Paul, came forward and said the lawsuit has "absolutely no merit" because his client already paid $23,000 for the song.

"Kim's attorney and account have double and triple checked everything that she's done," Paul told Radar Online

Paul said Burruss' suit is unwarranted; that it stems from her handling the business side of music very "sloppy and messy."

"You can't then say after the fact that you should have done this and you should have done that," he said.

Paul said four people are responsible for writing the song - Zolciak, her daughter, Burruss and DonVito - and Burruss was paid a sum for her participation.

"To date, Kim has written checks to Kandi and Don Vito in excess of $23,000," Paul said. "In fact, we believe that Kim may have overpaid a portion of their share to date based on the actual record sales," he said.

Paul also said that the timing of the lawsuit is suspicious, adding, "Why now? Two days before the reunion show is taped, the lawsuit lands on Kim's desk. Awfully suspicious timing."

Burruss wrote in her Bravo TV blog in October of 2010 that Zolciak never paid her for the song, She posted, "I hardly got anything from Tardy for the Party. That is the truth. I am not mad about it. I really blame myself because I didn't handle my business correctly."

Burruss and Zolciak went on tour together to promote the iTunes hit and it was documented during season three of RHOA. The title for the song was the inspiration behind Zolciak's spin-off reality show on Bravo Don't Be Tardy for the Wedding, which aired in April of 2012.
