Usher's ex-wife Tameka Raymond filed for custody of their two children on Tuesday after a pool incident that left her 5-year-old son in a hospital.

Tameka, who divorced Usher in November 2009, filed court papers asking for an emergency hearing, claiming that the 34-year-old singer is "creating a dangerous environment" for their children not long after Usher Raymond V was injured in the family's pool. TMZ reported that the documents were filed in Fulton County, Ga., with a request for a hearing to take place later this week.

Usher V's arm got stuck in a drain of the pool after trying to retrieve his toy that fell deep down. At the time he was under the supervision of the singer's aunt, Rena Oden. He was rushed to the intensive care unit after CPR was performed by two men working in the house.

Usher was not home at the time.

Tameka is allegedly claiming that she is doubtful of the people who Usher leaves with the kids. She reportedly complained about Oden in the past, saying that she once let a stalker in the house where Usher and the kids were staying.

The incident comes a year after Tameka's 11-year-old son Kile Glover died following critical injuries from a boating accident. Glover was hit in the head during a jet ski collision while riding an inner tube in an Atlanta lake. The boy was put on life support and died two weeks after. At the time of Glover's death, Usher won custody of Usher V and Nayvid, 4.

Usher's lawyer said that Tameka was "incapable of being a proper parent" to their children and said she "does not have the emotional stability or capacity to bond with them, and therefore she is handicapped."
