AZ Central reported on Tuesday that according to an opinion filed by the Arizona Court of Appeals, Arias' testimony from Oct. 30 must be made public.

Last month AZ Central reported that Judge Sherry Stephens' ruling to keep the public and press out of the courtroom during the first witness' testimony had been overturned by the Court of Appeals.

The ruling may have been overturned, but Arias' defense team has promised to take the matter up for review with the Arizona Supreme Court.

Judge Stephens reportedly granted the private testimony on the grounds that Arias had claimed that she had received death threats and feared her testimony would anger the public and therefore damage her right to a fair trial.

David Bodney, an attorney representing the news organizations that protested Judge Stephens' ruling back in October, believes the transcripts must be unsealed as soon as possible as a matter of constitutional law.

AZ Central further reported that in a written response to the media's request for the transcripts a Superior Court representative said Arias' defense team is objecting the decision and is filing a petition for review with the Arizona Supreme Court so no documents would be released at this time.

According to the filing, Arias refused to testify before the media because the coverage would prevent her from being "able to fully communicate what she wants to say, communicate her remorse and go through all the mitigating factors and get them out there in front of the jury with…the public there."
