After one year of separation from her estranged husband, Hilary Duff has ofically filed for divorce from Mike Comrie.

On Saturday, TMZ reported that the singer and actress has filed for divorce, and that it comes the morning after Comrie was seen "drunkenly propositioning women" at Mastro's steakhouse in Beverly Hills.

Duff has reportedly hired an attorney, Laura Wasser, as she is asking for primary physical custody of their almost 3-year-old son, Luca.

She reportedly wants Comrie to have visitation but is worried that his partying and drinking may interfere with his well-being and could adversely affect their son.

The couple reportedly signed a prenup when they wed, but neither are struggling with finances. Duff allegedly just wants to make sure her earnings and possessions remain hers.

The two married in 2010 and when they separated, Duff's mom, Susan, reportedly said, "They're better friends than a married couple."

The two, though divorcing, will likely remain civil for Luca.

"We're constantly seen together and people are like, 'What are they doing? Are they back together? Are they not?' We're really good friends and we have so much respect for each other and obviously Luca is our No. 1 priority," Duff told E! News. 

In an interview with Health, Duff admitted that the two still love each other.

"We have a two-year-old together. We love each other. Obviously it wasn't a rash decision that we made. We really are just trying to figure out how we are the most happy -- whether together or apart -- and we're doing it as lovingly as possible," Duff said.
