Kim Zolciak is victorious in her legal battle with her former Real Housewives of Atlanta co-star Kandi Burruss.

Enstars reported in March that Burruss claimed there was copyright infringement over the song she wrote for Zolciak, Don't Be Tardy For The Party.

However, Zolciak won her counter-suit based on a federal jurisdiction technicality, according to TMZ.

According to a March report, Burruss' petition stated Zolciak commercially released the single record without the songwriter's "authorization, license or consent."

A week later, a rep for Zolciak, Mike Paul, debunked the claim. Paul told Radar Online Burruss' suit is unwarranted. He said the lawsuit has "absolutely no merit" because his client already paid $23,000 for the song. He also said Burruss handled the business side of music very "sloppy and messy."

"To date, Kim has written checks to Kandi and Don Vito in excess of $23,000," Paul explained at the time. "In fact, we believe that Kim may have overpaid a portion of their share to date based on the actual record sales," he said.

Burruss wrote in her Bravo TV blog in October of 2010 that Zolciak never paid her for the song. She posted: "I hardly got anything from Tardy for the Party. That is the truth. I am not mad about it. I really blame myself because I didn't handle my business correctly."

Burruss and Zolciak went on tour together to promote the iTunes hit and it was documented during season 3 of RHOA. The title for the song Don't Be Tardy for the Party was the inspiration for Zolciak's spin-off reality show on Bravo Don't Be Tardy for the Wedding, which aired in April of 2012 and season 2 titled, Don't Be Tardy which ended in June.

The Grammy Award-winning former Xscape singer was represented by her Housewives co-star Phaedra Parks, who is one of Atlanta's famed entertainment attorneys.
