Jenelle Evans claims she has full custody of her second son, Kaiser.

'Teen Mom 2' Star Jenelle Evans Arrested For Assault

After being arrested on Thursday after allegedly assaulting the new girlfriend of her ex-fiance, Nathan Griffith, the Teen Mom 2 star has spoken out, revealing that because she and Griffith haven't yet gone to court in regard to their son, she has full rights -- by default.

“Nathan hasn’t seen Kai in a week,” she told Radar Online on Friday. “In the state of South Carolina, if no custody is in place, then I have full rights.”

Will 'Teen Mom 2' Star Jenelle Evans' Broken Engagement Impact Her Custody Case?

Evans and Griffith welcomed son Kaiser in June 2014, one year after their relationship began. Then, one year after that, the couple parted ways and Griffith wasted no time moving on with Jessica Henry, the woman Evans is accused of assaulting.

“Jenelle told Nathan to come get his stuff out of their house because she is moving in two weeks and he brought his new girlfriend, Jessica Henry,” an insider told Radar Online. “This really made Jenelle mad. They ended up getting in a fight and she threw a glass at Jessica. So Nathan called the cops.”

According to the source, Evans reportedly believed Griffith set her up to "make her look bad," which he denies.

“I have no idea what he said and I don’t want to know," Evans said in response to her ex's denials. "He can say what he wants to, but I’m keeping comments to myself.”
