Pete Davidson’s NSFW Joke Could Cost Him Daughter’s Custody— Actor Faces Massive Child Support Battle

Comedian and actor Pete Davidson could be facing a hefty child support bill and a custody drama after splitting from Elsie Hewitt, with whom he shares a daughter, Scottie Rose. A family law expert has weighed in on the potential legal outcomes if the two end up in court.
Frank Perrone, co-chair of the Matrimonial & Family Law Practice at Tarter Krinsky & Drogin in New York, told The US Sun that Davidson would likely seek 50/50 parenting time as the non-custodial parent. However, Perrone cautioned that Pete's demanding and unpredictable work schedule could weigh against such an arrangement, emphasizing the importance of stability and consistency for the child's development.
Because of Pete's frequent travel for stand-up comedy tours and movie filming, maintaining a consistent parenting schedule is challenging, Perrone explained. Meaningful and regular contact is critical for both the child's growth and the parent-child relationship.
As per Perez Hilton, behavioral factors could also influence custody decisions. Last month, Davidson made a controversial joke during a Las Vegas stand-up show, referencing watching pornography in front of his newborn daughter. Perrone said such remarks could be viewed negatively in court, potentially harming Davidson's custody prospects.
In contrast, Elsie Hewitt has publicly shared personal details about their split and financial struggles on social media platforms like TikTok. Perrone warned that airing such matters publicly might also hurt her standing in court, as judges typically disapprove of parents using social media to discuss private family issues.

Regarding child support, reports indicate Davidson earned over $3 million in 2025, while Hewitt made hundreds of thousands through paid partnerships. Perrone estimated Davidson's child support obligation could reach approximately $510,000 annually, or about $42,500 per month.
As of now, there is no confirmation whether Davidson and Hewitt will settle parenting and financial matters privately or pursue formal court proceedings. Experts say an out-of-court settlement would be better to avoid protracted legal battles that could affect their daughter.
