Actress Nicollette Sheridan was granted a retrial date for her wrongful termination suit against the creator of the hit TV show "Desperate Housewives."

Sheridan's lawyer told the New York Daily News that the judge rejected ABC and Disney's motion to dismiss the case and set a follow-up trial for September 12.

"We think it's a really good case. It's very simple and straightforward. She was hit in the head, she complained and she was fired," Lawyer Mark baute told the paper.

Sheridan accused "Desperate Housewives" creator Marc Cherry of smacking her on the head during a rehearsal. She argues that she was fired and her character
Edie Brit, killed after she made a battery complaint.

In response, Cherry said he only tapped the actress to show her how he wanted her to make the scene and the death of Britt was planned long before.
