A source said Thursday that she has refused to wait for him while he serves his sentence.

"Phaedra has been patiently waiting for Apollo to begin serving his sentence, and will have him served with divorce papers at the correctional facility in Kentucky."

The couple has two boys, Dylan, 1 and 4-year-old Ayden, together. Despite parenting the children, the insider added that Parks and Nida's marriage had lots of trouble long before his legal troubles began. From infidelity issues to different opinions on how to handle their finances, the reality TV stars' marriage has been on the rocks for some time.

"The marriage was a huge mistake, but did give her their beloved kids. There were serious trust issues with Apollo, and Phaedra suspects he has been unfaithful, and has been burning through money. Phaedra has always been the breadwinner, and she began to resent it."

To make matters worse, Nida failed to report to federal prison in Lexington, Ky. to begin his sentence Wednesday. Instead he went home and fought with Parks in the home they shared together.

A different source said, "Apollo came out of nowhere and ran around the house."

They added that Parks has been wanting to end their marriage but was afraid to. Now that he is in jail, she feels better about getting a divorce and has already reportedly signed the papers.
