Back in June 2010, Joe pretended to be his brother Pietro, in order to obtain a license. At the time his was invalid after being popped for a DWI five months prior. He got caught after a patrol car pulled over Pietro, ran his license and saw Joe's photo instead. It turns out Joe has agreed to a plea deal. He has a hearing scheduled for Wednesday.

But it was after "prosecutors signed off on allowing Joe to serve prison time in the drivers license case concurrently with the bankruptcy fraud," an insider told Radar Online Monday. "It's likely Joe will remain behind bars longer than the 41 months in prison..."

As for Teresa, she is rumored to be letting Joe stick this one out on his own.

"[She] has no plans on going to court with Joe on Wednesday for the sentencing. she hasn't been to one appearance with him for this case, so she figures why now?" the same source added.

Teresa will begin her 15-month sentence in January. When she is finished, Joe will begin his.
