Bethenny Frankel's divorce battle with her soon-to-be ex-husband might reach a boiling point as the two are headed for the stand over the custody of their 4-year-old daughter, Bryn.

The Skinny Girl mogul and her estranged husband, businessman Jason Hoppy, are scheduled to make an appearance in front of a judge next week as they'll be arguing who should have custody of their daughter.

A source tells Radar Online that attorneys for both Frankel and Hoppy did file the appropriate documents needed to keep the courtroom battle sealed, allowing the press to observe their proceedings instead. With all the bad publicity Frankel has been receiving this could mean that the former reality television star might not be putting up the same fight she would behind closed doors in fear that any negative details surrounding the custody battle might further hurt her already damaged public image.

Despite this, it looks like Frankel is still refusing to settle as Hoppy had hoped to do so with his estranged wife.

A source tells Radar, "Bethenny sat outside the courtroom and made notes on what looked like a script of a book draft. There were no tears or emotions. Both Bethenny and Jason looked very somber."

Frankel and Hoppy will be taking the stand in a Manhattan family courtroom next Wednesday. The ex-couple married in March 2010, two months before the birth of their daughter and announced their separation in December 2012.
