Jonathan Kirby, the man who allegedly broken into rapper/actor LL Cool J's home on Aug. 21, was charged with residential burglary on Thursday.

LL Cool J was not injured, but the same can't be said for Kirby - who suffered from a broken nose, jaw and ribs at the hands of the "NCIS: Los Angeles" star, reported the LA Times. The star later told authorities he acted out of concern for his family.

Kirby, 56, is a third-strike offender, which means he could face a maximum sentence of 38 years in state prison. He might also face a battery charge.

LL Cool J apprehended the intruder after he heard commotion in the lower-level of his house in Studio City, Calif. The robber's attempts were foiled when he tripped the alarm system after he entered the Los Angeles area home, according to TMZ. When the 44-year-old actor and two-time Grammy Award winner discovered him, he held the intruder and roughed him up until police arrived.

Local authorities received a 9-1-1 call after midnight from a female who said her father was holding a robber downstairs, according to The Associated Press.

Kirby, a homeless man originally from Texas, has a record of thefts, disorderly conduct and other criminal activity across Los Angeles and several Orange County areas.

The Times also noted that court and prison records indicate Kirby was sentenced to five years in prison for burglary in the 1990s and three years in prison for petty theft in 2005. He served jail time for another theft conviction and was discharged from prison on Feb. 1.

Investigators suspect Kirby may be responsible for other break-ins in the Studio City area in recent weeks and prosecutors have asked the judge to set Kirby's bail at $1.1 million, TMZ reported
