While announcing Suraj Pancholi's granted bail on Monday, after he was charged of abatement to the suicide of Bollywood actress Jiah Khan, the Bombay High Court pointed out that the late 25-year-old had a "suicidal tendency."

The court ruled that Khan's suicide note was not enough to hold Pancholi in custody any longer, according to One India News. He was originally arrested in early June on the basis of the six-page letter, which noted that he was in a troubled relationship with the actress. Granting bail to Pancholi, the court said:

"...It cannot be said that on June 3, he (Suraj) had acted in any manner which could reflect a mens rea (intention) that he wanted her to commit suicide. In the absence of any mens rea, instigation or aid, it cannot be said that (Suraj) had driven her to commit suicide on that day."

The court questioned Khan's alleged suicide note, submitted by her family days after her suicide, and its actual connection to Khan's hanging that took place on June 3 in her Mumbai home. The note was not dated and therefore could not be directly linked to the suicide.

"Is the script addressed to Suraj or (are they) extracts from her diary? Whether it can be called a suicide note? When there is no date on it can it be linked to the day she committed suicide?"

The judge also noted that it could not be proved that Pancholi "caused disappearance of evidence" related to the suicide case.  

Speaking about Khan's nature, the court noted that Pancholi helped her when she had tried to commit suicide. However, repressing the statement of Mumbai Police over her abortion, the court said, "...abortion appeared to be out of (her own) volition and therefore it cannot be said that (Suraj) had forced her to undergo medical termination of pregnancy or otherwise."
