In January 2022, Fishburne, 32, found herself in a legal battle after being apprehended by Broward County sheriffs and charged with battery on a law enforcement officer. The incident stemmed from a 911 call Montana made, reporting an ex-boyfriend for alleged stalking and threats against her.

Upon police arrival, no one was present at the reported location. Accounts from police records indicate Montana grew agitated, alleging lack of assistance, and confronted officers on the sidewalk near the address. Despite repeated instructions to step back, she purportedly struck one deputy on the head, resulting in swelling and redness on the officer's ear, according to the police report.

Montana's probation will conclude upon successful completion of a 13-week anger management program.

This isn't Montana's first encounter with the law.

In 2017, she faced three misdemeanors for a DUI, being released the following day after posting a $2,500 bond. Then, in 2020, she faced another DUI charge in Florida and was once again released on bond.
