Tracy Morgan Is 'A Fighter' But Still Struggling After Walmart Car Accident

Fans can also currently hear Morgan in the animated film The Boxtrolls starring Elle Fanning and Ben Kingsley, which is out now in theatres.

Morgan's lawyer Benedict Morelli previously told Page Six that "the jury's still out" on whether Morgan would perform again. "The doctors don't know the answer. I don't know the answer."

Morgan is currently recovering from his car accident where his limo was hit by a Walmart truck in New Jersey.

In a new response, Walmart tried to blame Morgan for not wearing his seatbelt in the limo. "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests," Walmart's 28-page response read. "Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise of reasonable conduct using the available seatbelts."

Morgan's lawyer than issued a statement on behalf of the comedian where he said Morgan was "shocked" by Walmart's comments.

Top Five opens in theatres Dec. 12 everywhere.
