Catherine Bosley Wet T-Shirt Photo Lawsuit Won: Jury Awards $135K to News Anchor
News anchor Catherine Bosley won a lawsuit against pornography publisher Hustler Inc. over the use of a photograph taken in 2003 where she appeared in a wet T-shirt contest.
On Thursday, a federal appeals court ruled that Hustler Inc. had no right to publish Bosley's picture and awarded Bosley $135,000 plus attorney fees, according to Reuters and the Associated Press.
Hustler published Bosley's pictures in 2006 under a series titled "Hot News Babes" but the news anchor had already registered the photos 2 years before with the U.S. Copyright Office in 2004.
When the news anchor sued Hustler, the company claimed that it used the image under the "fair use" exception.
But the jury ruled against them and said the publisher's main goal was to make money off the image, according to Reuters.
The incident happened while she was working at CBS' affiliate WKBN-TV in Youngstown, Ohio. She is currently working at WOIO-TV in Cleveland.
