The famous Giudice couple of The Real Housewives of New Jersey seem to be strategizing when it comes to their fraud trial, set to take place this April, and it looks like Joe is going to take the fall.

Teresa Giudice and her husband have now asked to be tried separately, People reported Wednesday, so that Joe can testify that Teresa was not only not involved in any criminal activity, but that she had no idea it was even taking place.

According to court documents, "Should the trials be severed, Mr. Giudice has affirmed his willingness to testify as to Teresa's involvement in the alleged criminal activity. He would be unable to do so in a joint trial wherein his Fifth Amendment rights are invoked."

If tried without his wife, Joe is reportedly going to testify that Teresa didn't know properties and businesses were put in her name; and that he and his business partner, Joe Mastropole, as well as his attorney, Fred Roughgarden, all signed her name on documents without her knowing.

On top of that, Joe is set to claim that bank workers knew that Teresa didn't sign important documents like loan and mortgage applications and lines of credit.

The couple is currently being charged with 41 counts of fraud from loan to bankruptcy fraud and could spend up 50 years behind bars if convicted.

Joe is also in legal trouble after being charged for using fake identification to obtain a driver's license. That trial date has not yet been set.
