The Jodi Arias retrial resumed Monday, which led to a fuming defense over the latest motions to allow the public and media to see and hear all testimonies in the courtroom.

Judge Sherry Stephens' Ruling From Oct. 30 Overturned In The Jodi Arias Retrial By Court Of Appeals

Last month on Nov. 26 it was ruled by the Court of Appeals that Judge Sherry Stephens' Oct. 30 ruling to keep the media and public out of the courtroom during the first witness' testimony was officially overturned.

It was then discovered that Arias was most likely the witness who was kept in secrecy when testifying back in October as reported by Fox News since Judge Stephens said the courtroom would remain closed to the public during "any testimony by Jodi Arias."

As of Monday, Radar Online has learned that there are three other defense witnesses who refuse to testify in public. Arias' attorneys argued that Arias couldn't have a fair trial if her and those three witnesses are not allowed to testify in secrecy. She could possibly receive the death penalty for killing her ex-boyfriend Travis Alexander.

It was reported that the three witnesses include, "a longtime boyfriend, a former co-worker and an individual who knew Mr. Alexander before he met Ms. Arias and who would have provided the jury with testimony that Mr. Alexander confessed his interest in child pornography to him," according to a motion filed by Arias' lawyer Kirk Nurmi.

Nurmi argued that since the Court of Appeals overturned Judge Stephens' ruling it "has further inhibited Ms. Arias' ability to present a complete defense of her life to the point that should a sentence of death be imposed by this jury, said sentence would be unconstitutional."

Radar Online further reported that Nurmi argued that in the original decision to close the courtroom, the judge "already determined that if Ms. Arias had to testify in proceedings that were not sealed from the public and/or the media she would be prejudiced."

"A fatal blow" has been dealt, which could lead to a death sentence, which is not fair according to Arias' defense team.
