She has reportedly returned to a lucid state and seems the healthiest she's been yet, but Amanda Bynes could still find herself in some legal trouble.

The former actress, who was arrested for a DUI in September after driving under the influence of Adderall, could actually face jail time for the incident-even though the case was thrown out.

According to TMZ, while the Los Angeles City Attorney didn't believe he could sell a case to the jury because Bynes had a relatively low level of the drug in her bloodstream at the time of her arrest, he has now referred the case to the District Attorney because having any Adderall in her system could possibly constitute a probation violation.

Bynes was previously convicted for a DUI back in 2012, and if the DA does choose to revoke her probation as a result of the September incident, she could find herself thrown in jail.

However, because of Bynes' mental health issues (she was previously diagnosed with schizophrenia and bipolar disorders in 2013), the D.A. could forgo prosecuting her if he feels it could interfere with any treatments she may be receiving.

Following her arrest in September, Bynes appeared to have relapsed into the behaviors that got her put into an involuntary 5150 psychiatric hold and six-month rehab stay bac in 2013. She was released into a conservatorship with her parents at the end of the year, and had seemed to be repairing her life throughout 2014, especially after she enrolled at the Fashion Institute of Design and Merchandising.

However, she was later revealed to have been dropped from the school, and appeared to once again be off medication and in a bad state.

She was most recently reported as being lucid and stable once again.
