Republican Rep. Allen West fell short Tuesday night in his hard-fought Florida race against his Democratic competitor Patrick Murphy. Even with the ballots counted, West isn't giving up yet or accepting his loss.

According to FOX News, West has reportedly filed at least two motions Wednesday, in West Palm County and St. Lucie County for injunctions in order to conduct a recount of paper ballots.

He also requested an examination of voting machines used in the contentious contest. West refuses to content to Murphy's victory.

"This race is far from decided, and there is not rush to declare an outcome," West said in a written statement.

"Ensuring a fair and accurate counting of all ballots is of the utmost importance," he continued. "This race is far from decided."

West demanded for an early recount when the first ballots were announced in St. Lucie District when the county supervisor had shifted his total vote count from a lead of 2,000 to 2,400.

West said they "were other numerous disturbing irregularities" at the polls in St. Lucie. He claimed the doors to the polling places were locked right after polls had closed, which is an "indirect violation of Florida law."

According to The Huffington Post, Murphy is leading West 50.4 percent to 49.6 percent with a 100 percent of the votes counted. That means Murphy had 160,328 votes to West's 57,862.

This is the only House race in Florida that has yet to be called.

Meanwhile, Murphy has already declared himself the winner after coming out in the initial vote count which indicates that he is ahead with 2,456.

"I am humbled by the outpouring of support from the voters of the Treasure Coast and Palm Beaches," Murphy said in a news release. "I pledge to be a representative who will work across the aisle, listen to all points of views and work to end the divisiveness in Congress. Our country faces many challenges, and by working together we will continue to move our country forward."
