A 37-year-old repeat drunken driver is suing a friend and the restaurants that served him alcohol for his crash that killed two teenage sisters in 2010.

James Ruiz filed the lawsuit without a lawyer on Wednesday in New Mexico District Court seeking monetary damages from Applebees, Blue Corn Café and his drinking buddy at the time, the Albuquerque Journal reports.

His suit allegedly claims that "negligence" from his friend and the restaurants contributed to his stress. Ruiz was out on bond on his fifth DWI arrest when the accident happened, the publication reports.

Last month, Ruiz filed a court petition for a new trial and alleged that his lawyers didn't represent him effectively. He is serving a 40-year sentence after pleading guilty in 2011.

According to the Associated Press, police say Ruiz had a blood-alcohol concentration of 0.22 percent at the time.

The two teenagers were Del Lynn Peshlakai, 19, and Deshauna Peshlakai, 17 and were from the Navajo Reservation. Their family filed a wrongful death suit, which is still pending in the state district court, against Ruiz and others involved.
