Halle Berry's ex-husband Gabriel Aubry will not face criminal charges for the Thanksgiving Day fight he had with the actress' fiance Olivier Martinez, the Los Angeles City Attorney's Office ruled Wednesday.  

Attorneys for Berry, Martinez and Aubry have all agreed to settle the case without getting into a criminal trial. An informal hearing will instead be held to discuss the incident and law enforcement sources said that the likely outcome will be anger management classes for Aubry, Daily Mail reported. No date has been set for the hearing at time of publication.

Investigators said they believe Aubry initiated the fight, despite a photo supporting the claim that he got more injured during the fight that Martinez. The French actor only sustained a injured hand.

The fight happened after Aubry dropped off his four-year-old daughter with Berry, Nahla, the actress' California home. Olivier reportedly followed him outside and told him 'they needed to talk." The news report said that Aubry allegedly pushed Martinez and attempted to punch him in face but hit his shoulder instead. In an act of self-defense, police sources said Martinez took three quick punches to Aubry's face, which resulted in the injuries and bruises the Canadian model has been sporting since. Aubry was arrested on suspicion of misdemeanor battery after police responded to a call that he had gotten into a physical fight with Martinez. 

However, Aubry claimed that Martinez threatened his life and shouted at him during their brawl, "You cost us $3 million. When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you." He added that Martinez punched him, kicked him and knocked his head into the concrete driveway of Berry's home. Aubry said security cameras from Berry's house would support his claims. 

He said in his court files filed in November that Martinez was the one who initiated the fight.

"It all happened so fast and so suddenly; I did not see Mr. Martinez's actions coming, and thus, I was not ready for it and was not able to defend myself," he said.
