A lawyer who formerly represented an LA masseur when he filed a sexual assault and battery lawsuit against Hollywood star John Travolta has filed a motion to dismiss the lawsuit this morning. RadarOnline.com exclusively reported that attorney Okorie Okorocha filed the motion to dismiss the suit for the first accuser but will continue to represent another spa employee in Atlanta who is also filing suit against the actor. The suit was dropped after the man admitted that he got the date of the alleged attack wrong.


Okorocha told RadarOnline: "I'm going to file a dismissal of John Doe #1's lawsuit on Tuesday morning, without prejudice. I could no longer represent him because he was speaking to the media against my advice, and it made no sense to me. I don't think that John Doe will be pursuing the lawsuit."


The unidentified masseur claims that the 58-year-old actor assaulted him sexually during a massage in January inside a room at the Beverly Hills Hotel, according to court documents.


The masseur, referred to as John Doe in court papers obtained by Reuters and earlier this month, claimed that Travolta rubbed his leg, touched his genitals and tried to initiate at least one sex act inside a private bungalow at the exclusive hotel on January 16.
However, Travolta's attorney has blasted the accusations, saying: "On the date when plaintiff claims John met him, John was not in California and it can be proved that he was on the East Coast. John intends to get this case thrown out and then he will sue the attorney and plaintiff for malicious prosecution."


Since the first accuser filed the lawsuit, two more men came out, claiming that Travolta made sexual advances at them. Travolta's lawyer issued a statement:  "This is just another ridiculous claim by someone hopping on the bandwagon to get his 15 minutes of fame with a story about something that supposedly happened over three years ago."
